Disney's Pete's Dragon Sweepstakes

1. Eligibility

The “Your Pet Dragon” (“Sweepstakes”) is open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia (excluding Hawaii, Alaska, and its territories and possessions) who are at least eighteen (18) years old at the time of entry (or the age of majority in their state of residence, whichever is older). Employees of Budsies PR LLC, ABC, Inc. dba Walt Disney Studios Motion Pictures and other companies associated with the promotion of the Sweepstakes, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members (those who share the same residence at least three (3) months a year whether or not related) of each such employee are not eligible to enter or win.

2. Sponsor

The Sweepstakes is sponsored and operated by Budsies PR LLC (“Sponsor”), located at 1700 Depot Ave, Suite 7, Delray Beach, FL 33444.

3. Agreement to Official Rules

Participation and entrance in the Sweepstakes constitutes entrant's full and unconditional agreement and acceptance to be bound by the Official Rules and the decisions of the Sponsor, which are final and binding. Winning a Prize (as defined herein) is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Sweepstakes Periods

The Sweepstakes is divided into four (4) separate and distinct drawings (each referred to as a “Sweepstakes” and collectively as the “Sweepstakes”) with entry periods provided in the chart below (the “Sweepstakes Entry Period(s)”). Each Sweepstakes will consist of its own entry pool.  For the avoidance of doubt, Entries (as defined herein) received for each Sweepstakes will NOT carry over to subsequent Sweepstakes Entry Periods.

5. How to Enter

To participate in the Sweepstakes, you must have the Instagram application on your mobile device and an active Instagram account (“Account”) in good standing. If you do not have an Account, open the Instagram application on your mobile device and sign up for an Account according to the instructions provided. Creating an Account is free. You must accept the Instagram Terms of Use to create an Account and you must be logged in to your Account in order to enter. Use of the Instagram application requires a mobile device and therefore message and data rates may apply.

Upload a photograph of your pet to your Instagram Account and (1) tag it with the appropriate hashtag (per the chart above) and (2) follow @petsies.

Qualifying entries (each an “Entry” and collectively referred to herein as “Entries”):

- Must be an Instagram post tagged with the appropriate hashtag (per the chart above) and follow @petsies on Instagram

- Image must be posted from a publicly visible Instagram Account

- Image must be of an animal owned by the person entering Sweepstakes

- Image must clearly show entire animal (grainy, out of focus, or photos showing only a part of the animal are not qualifying Entries)

            Photograph Guidelines:

(a)    Photos cannot contain any content providing personally identifiable information about yourself or any third parties, such as last name, address, phone number or any contact information;

(b)   Photos cannot contain content portraying or referring to people or characters from movies/shows, video games, etc.;

(c)    Photos cannot contain any content in violation of third-party rights including, but not limited to: copyrights, trademark, right of publicity or any other proprietary rights; 

(d)   Photos cannot contain any content (i) that is libelous, defamatory, disparaging or tortious;  (ii) that is pornographic, adult-oriented or sexually-explicit; (iii) portraying or referring to lotteries or gambling; (iv) portraying or including explicit or offensive language; (v) portraying or advocating discrimination; and (vi) portraying or advocating tobacco, alcohol or drugs;

(e)   Photos cannot contain content that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any basis protected by federal, state, or local law, ordinance, or regulation; and

(f)     Photos cannot contain content that (i) denigrates, disparages or reflects negatively on the Sponsor and/or Disney, their products or employees, or on any other person, company, product or service, and (ii) is in violation of any law or regulation.

If a photo does not comply with the requirements listed above or includes any of the prohibited elements listed above, the photo will be disqualified, along with the entrant who submitted it. The above list is not intended to be exhaustive; Sponsor may disqualify any photo if it contains content that Sponsor deems, in its sole discretion, to be inappropriate, offensive or obscene in any way or to not be in compliance with these Official Rules.

By submitting a photo, you hereby represent and warrant that: (a) your photo is original; (b) you have not included any restricted content in the photo and have not violated any of the requirements listed herein, and; (c) you consent to the submission and the use of the photo.

Limit one (1) Entry per person.

6. Winner Selection

On or about the Winner Determination Dates set forth in the chart in Section 4 above, Sponsor will randomly select the number of winners set forth in the aforementioned chart. Entries will not be judged. If a winner is unwilling/unable to comply with these Official Rules, winner will be disqualified and an alternate may be selected.  Sponsor is not obligated to notify you if your Entry is disqualified.  For each individual Sweepstakes, the odds of winning depend on the total number of eligible Entries received for that specific Sweepstakes Entry Period.

7. Notification of Winner(s)

Winners will be notified on or about three (3) days following Winner Determination Dates above via Direct Message on Instagram from the @petsies account. Upon verification of eligibility and winner’s shipping address, Sponsor will begin production and delivery of the Prize, which may take five (5) to eight (8) weeks. Notified winners have ninety (90) days to confirm their shipping address and claim their Prize. Unclaimed Prizes are forfeited.

8. Prizes (each a “Prize” and collectively referred to herein as “Prizes”)

Each winner will receive the following Prize:

One (1) 16” Petsies custom plush stuffed animal of their pet with dragon wings, including shipping to continental U.S. Approximate retail value (“ARV”) of each Prize is $160.  Total ARV of all Prizes for each Sweepstakes is $3,975.

The Prize is non-refundable, non-transferable, and not exchangeable for cash, credit or any other item. Sponsor reserves the right to substitute a Prize for one of equal or greater value for any reason. All winners shall accept Prizes as they are and subject to any terms and conditions of said Prize.  All Prizes will be awarded provided a sufficient number of eligible Entries are received. Winners shall be solely responsible for any tax liability as a result of receiving a Prize.

9. Right to Amend/Cancel

The Sponsor reserves the right to cancel or amend the Sweepstakes and these Official Rules without prior notice in any event deemed to be outside of the Sponsor’s control. Any changes to the Sweepstakes will be notified to entrants as soon as possible by the Sponsor via the @petsies Instagram account.

10. Unreceived Entries

No responsibility can be accepted by the Sponsor for Entries not received for whatever reason.

11. Technical Difficulties

Sponsor is not responsible for any problems or technical malfunction or error of any kind. If the Sweepstakes is not capable of running as planned for any reasons including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, without prior notice, to cancel or modify the Sweepstakes.

11. Publicity

By participating, each entrant grants Sponsor permission to use his/her name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.

12.  Ownership of the Entry

By entering the Sweepstakes, you represent and warrant that you are the rightful owner of your photograph and the pet shown in the photograph.

You give a non-exclusive license to the Entries to the Sponsor for promotional purposes. Entries will not be acknowledged or returned.

By providing your email address, Sponsor may email you company updates, special offers, announcements and other promotional material. You can unsubscribe at any time. Email address not required for Sweepstakes entry and is subject to Privacy Policy listed at https://www.budsies.com/privacy-policy/

12. Social Media Release

This Sweepstakes is NOT ENDORSED BY FACEBOOK, TWITTER, PINTEREST, INSTAGRAM, or any other social media sites (“Social Media Sites”): By participating in this Sweepstakes, you acknowledge that this Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Pinterest, Instagram, or any other social media site/platform and release the aforementioned Social Media Sites from any and all liability arising from or related to this Sweepstakes. Any questions, comments or complaints regarding the promotion will be directed to the Sponsor, not the aforementioned Social Media Sites.

13. Legal

To the fullest extent permitted by law, you also agree to release Sponsor and ABC, Inc. dba Walt Disney Studios Motion Pictures and their respective employees, affiliates and agents from any and all liability, loss, damage or injury by or to any person in connection with the Sweepstakes. Sponsor does not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or the Prizes.

The Sweepstakes shall be governed by and construed in accordance with the laws of the State of Florida, without giving affect to any choice of law or conflict of law rules or provisions. Any legal claim arising out of the Sweepstakes must be brought in state or federal court located in Palm Beach County, Florida.  Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Prize awarded shall be resolved individually, without resort to any form of class action.
